Bars be aware of your responsibility
Letter to the editor,
On Sept. 18, 2004 Lake of the Woods claimed the life of Jimmy Olson, after he and three friends spent the day fishing and drinking, ending up at a lodge just after 4 p.m.
They spent approximately 3-4 hours at the bar where a tab of 36 drinks was accumulated. After leaving the bar destined for Morson, Ont., which is a 1 hour and 20 minute boat ride, and dark at the time, Jimmy, 32, fell out of the boat and drowned.
As a result a lawsuit was brought against the bar for illegally serving Jimmy Olson in an obviously intoxicated state, based on evidence showing how much he had consumed during the day as well as the damaging bar tab.
The bartender admitted the group was loud, obnoxious and used excessive profanities while in the bar. It was undisputed that Jimmy ordered a round of 8 tequila shots shortly before they left.
After nearly three years a settlement was reached. Although the defense vigorously denied any illegal sale, the evidence and settlement speak for themselves.
We would like other bars and establishments serving liquor to be aware of their responsibility when serving the public. If this can save even one life, then our son, brother and life partner did not die in vain. No family should have to go through this heart wrenching sorrow as we have and always will.
